Can you own property in Mexico?

Yes, foreign nationals can legally own real estate in Mexico.

However, there is a “restricted zone” that extends 50 km (about 30 miles) inland from the coastline and 100 km (about 60 miles) from international borders.

Outside this zone, foreigners may acquire property outright with the same rights as Mexican nationals.

Within the restricted zone, foreign buyers can still own property through a fideicomiso, a bank trust established with a Mexican financial institution. This mechanism has been safely used by international buyers since 1973.

Can the Mexican government confiscate my property?

This is a common concern, but the answer is reassuring.

Under the USMCA (formerly NAFTA), the Mexican government cannot arbitrarily expropriate private property.

Just like "Eminent Domain" in the U.S., land can only be expropriated for public use — and in such rare cases, the owner is entitled to prompt and fair compensation, including accrued interest.

Foreign-owned property held through a fideicomiso is legally protected under Mexican law.

Can my family inherit my property in Mexico?

Yes, and in fact, the inheritance process in Mexico can be more straightforward than in countries like the United States.

As long as a valid will exists, your heirs can inherit the property without lengthy probate procedures or additional estate taxes.

There is no inheritance tax in Mexico when the property is passed to direct family members under a legal will.

How does insurance work?

starting in 1996. Secure Title Mexico began to underwrite a title insurance for Mexican properties at an approximate cost of 1% of the insured amount. Other types of insurance, including property, liability, damages and shaking of land are all readily available in Mexico at low cost, and polícies can be written to pay claims in US dollars.

How much do housing taxes cost?

Property taxes have always been low in Mexico because that they have never been considered a source of government revenue Known as Predial, the tax is calculated as a percentage (currently 0.25% of the taxable value) determined at the time of sale. As a general rule you can expect to pay $100 USD for every $1,000 of $100,000 USD annual value.
